When my husband passed away 5+ years ago, unbeknownst to me at the time, he had established credit in his own name. Living in CA, which is a community property state, I believed that (even) because it wasn't a joint account, and I had no knowledge of the debt(s), I shouldn't/didn't have to pay them. One of them "wrote it off," however, they turned around and issued a 1099-Misc. form for the amount they wrote off, and I had to claim the full amount of the debt as income on my taxes. The other, who I battled with for a couple of years, finally garnished my wages to get money he owed. My advice? No matter what state you live in, partners should be aware of the others debts, regardless of whether they're responsible for them at the end of the day. Not knowing causes problems, and now that he's passed away, to the children he's a saint, but I feel a little differently about that, since I got stuck with the debt(s), and had nothing to show for it. It also hurt my credit score, because I was his wife, and we had joint credit as well.

Oh, I had a beaut....

About a year after my mother passed away, I had a debt collector call me and tell me that my sister had been using my mother's credit card since her death, and I was now responsible for the bills.

I told her that I wasn't responsible for my sister's debts, or my mother's debts, and that she should chase my sister if she could prove that my sister had, indeed, been using Mom's card.

I never heard from her again.
